(2)choosetherighttradetermsTherearetwotradetermsmainlyusedbyChinesecompany,FOBandCIF.However,thesetwotradetermsarenotthebestorappropriatechoicesforthecontractparitiesinthebackgroundthatthelineoflogisticsismoredevelopedthaneverbefore.Thereasonisabouttherulesofrisktransferstipulatedinthetwoterms----theriskoflossorcontaminationordamageofcargoesshallbetransferredfromsellertobuyerasofthetimethatthecargobeingtransportedacrossship’srail.Becausethetransferringplaceisship’srail,thetermsareonlyapplicableforshipping,morespecifically,non-containershipping.Incontainertransportation,cargoesareusuallydeliveredfromshippertocarrieratthecontaineryard,andbeingsupervisedbythecarrierthereafter.Theriskoflosingcargoisnotincontroloftheshipperanymoreduringthetimewhenthecargoistransportedfromthecontaineryardtotheship’srail.Inthecircumstancesthatthegoodsaretransportedbyairorroad,thereisnoship’srailinvolved,theboundaryofrisktransfercannotbeascertainedifFOBorCIFisstillapplied.This,accordingly,isofnogoodtoboththesellerandthebuyer.Actually,therearealsotwoothertermswhichareconvenienttouseininternationaltrade---FCAandCIP.ThecontentstipulatedinthesetwotermsaremostlikelythesamewithFOBandCIF,exceptthatthetimeofrisktransferisstartedfromwhenthegoodsaredeliveredtothecarrier.Thisruleofrisktransfermakesthetwotermsareapplicableinallwaysoftransportation,includingshipping.hotline:13910185386北京国际贸易律师
